Annulment of a Cluj-Napoca Local Council Decision Reclassifying Land from Within Buildable Limits (Intravilan) to Outside (Extravilan) <\/h2>\t\t\t\t<\/div>\n\t\t\t\t
\n\t\t\t\t\t\t\t\t\t

We bring to your attention an administrative litigation case concerning the annulment of a Cluj-Napoca Local Council Decision (HCL) that reclassified a parcel of land in Cluj-Napoca from inside buildable limits (intravilan) to outside buildable limits (extravilan). Under the 1998 General Urban Plan (PUG), the property was designated as intravilan; however, through a Local Council Decision enacted in 2014, the land was reclassified as extravilan without any legitimate legal basis, relying solely on the administrative authority’s discretionary assessment. <\/strong><\/p>

This situation is by no means unique. Public authorities can unilaterally enact such decisions to the detriment of private property owners, presenting them with a fait accompli where the legal, technical, and economic status of their real estate is altered. The primary challenges in such litigation involve proving the unlawfulness of the administrative decision ordering the reclassification\u2014particularly in scenarios where the landowner files a preliminary administrative complaint under Law No. 554\/2004 on Administrative Litigation, and the authority implicitly acknowledges its error by granting the complaint, yet fails to remedy the situation by issuing a new decision restoring the intravilan status. In such instances, the formal approval of the preliminary complaint yields no practical legal effect for the property owner. Another crucial issue involves proving pecuniary damage, the burden of which rests entirely on the plaintiff. Property owners frequently find that following an unlawful reclassification to extravilan, the land can no longer be used according to its original purpose, nor can it be economically exploited under its new designation. This occurs either because the surface area is insufficient for agricultural or industrial use (for example, constructing an industrial production hall requiring a larger area, such as 1,500 sq. m) or because the land becomes unsuited to the owner’s intended development plans (e.g., arable agricultural land versus land previously suitable for residential housing). <\/p>

Furthermore, property owners are often not notified by the administration of urban planning modifications affecting their real estate. Owners typically discover these alterations by chance when applying for an Urban Planning Certificate\u2014a moment marking formal awareness of the altered legal regime. Unfavorably, such reconfigurations may arbitrarily target a single parcel for exclusion from intravilan, while surrounding properties retain their intravilan designation under the justification that the authority holds discretionary power in establishing municipal buildable boundaries. In our view, this constitutes a clear abuse of power. Had the boundary reconfiguration been genuinely dictated by public interest, all adjacent properties in the area would have been reclassified as extravilan. Excluding a single property while leaving neighboring parcels in intravilan lacks objective criteria grounded in public interest. <\/p>

Legal doctrine establishes that administrative discretion is exceeded\u2014constituting an abuse of power\u2014whenever: there is no rational justification for the measures enacted, including instances where identical situations receive differential legal treatment <\/strong>(or distinct situations receive identical treatment); or where the administration restricts the exercise of fundamental rights without a rational justification establishing a proportional relationship between the measure, the factual circumstances, and the legitimate public goal pursued<\/strong>.[1]<\/a> This doctrinal framework directly applies to the specificities of this case.<\/p>

Property owners facing similar circumstances should note that they are entitled to claim damages for pecuniary losses, provided adequate evidence is submitted. <\/strong>Pursuant to Art. 18 para. (3) of Law No. 554\/2004 on Administrative Litigation, when deciding a claim, the court shall also rule upon material and moral damages<\/strong> if requested by the plaintiff. Under Art. 1,349 para. (1) of the Civil Code, every person has a duty to abide by rules of conduct imposed by law or local custom and refrain from infringing upon the rights or legitimate interests of others. Thus, the legal basis for tort liability rests on the adoption of the Local Council Decision unlawfully reclassifying the land to extravilan without a legitimate public interest justification. Regarding the harm suffered, Art. 1,357 of the Civil Code provides that whoever causes damage to another through an unlawful act committed with fault is obligated to repair it, answering even for the slightest fault. Furthermore, under Art. 1,381 para. (1) of the Civil Code, any damage gives rise to a right of reparation. In this scenario, the prejudice consists of the objective impossibility of enjoying and utilizing the land in according with its prior intended utility. Furthermore, if the land previously held economic value for residential development, its reclassification to extravilan explicitly prohibits such use, representing lost profits\/damages under Art. 1,385 para. (3) of the Civil Code. Additionally, land located in extravilan holds significantly lower market value than intravilan land, making the resulting decrease in property value a directly compensable loss.<\/strong> <\/p>

In conclusion, urban planning reclassifications can occur ad hoc without prior notice, often remaining undetected for extended periods. Nevertheless, affected landowners have the right to take legal action to protect their rights and legitimate interests. The administrative authority’s discretionary power to enact such modifications without a legitimate basis can certainly be censured in court, resulting in a favorable judicial outcome. <\/p>
